Retirement Plans. The firm drafts and seeks IRS approval of 401(k), 403(b), 457, profit sharing and defined benefit pension plans. Communications to employees with regard to such plans such as summary plan descriptions are prepared. Advice on reporting and disclosure and on compliance matters is provided. Represents employers during audits initiated by the Internal Reven Service or the Department of Labor.
Welfare Benefit Plans. The firm drafts plan documents such as self-insured medical plans, Code Section 125 ("cafeteria") plans and voluntary employee benefit trusts (VEBA). It also provides compliance guidance on the requirements of various health laws such as the Patient Protection and Affordable Care Act ("PPACA"), the Health Insurance Portability and Accountabilitly Act ("HIPAA"), the Consolidated Omnibus Budget Reconciliation Act of 1985 ("COBRA") as well as ERISA requirements for all tyoes of welfare benefit plans. In addition advice on the Illinois Insurance Code as it applies to employer sponsored group health plans is provided.
Employment Law. Advice is given on compliance with the Americans with Disabilities Act ("ADA"), the Age Discrimination in Employment Act ("ADEA"), Title VII of the Civil Rights Act, the Fair Labor Standards Act, the Illinois Human Rights Act,and the Illinois Unemployment Compensation Statute. Projects include but are not limited to preparing employee handbooks, employment contracts, employment forms and management employment policies.
